A revised Guidance Note on Tax Audit under Section 44AB of the Income Tax Act 1961 is been released by the Institute of Chartered Accountants of India (ICAI).

Section 44AB was incorporated into the Income-tax Act, of 1961, through the Finance Act of 1984. This section mandates the auditing of accounts for taxpayers whose total sales, turnover, or gross receipts exceed the specified thresholds of Rs.40 lakhs for businesses and Rs.10 lakhs for professions. The newly introduced Rule 6G, included in the Income-tax Rules, outlines the prescribed audit report forms for this purpose. These audit requirements are applicable to accounts pertaining to the previous year relevant to the assessment year 1985-86 and subsequent years.

Over time, the legislative framework has made it mandatory for corporate sector entities to undergo audits. Recognizing the significance of audits, this requirement has been gradually extended to encompass the non-corporate sector as well.

Exposure Draft – Guidance Note on Tax Audit under Section 44AB of the Income-tax Act, 1961

The updates to the ICAI’s Guidance Note on Tax Audit were primarily prompted by the following key amendments:

(a) Introduction of Forms 3CA, 3CB and 3CD in 1999 while omitting Form 3CC and 3CE.

(b) Revision of Forms 3CA, 3CB and 3CD in 2004.

(c) Revision of Form 3CD in 2006

(d) Revision of Form 3CD again in 2014 vide Notification No. 33/2014 dt. 25/07/2014.

The Institute of Chartered Accountants of India (ICAI) has invited input on the Revised Guidance Note on Tax Audit under Section 44AB of the Income Tax Act of 1961 (2023 Edition), which incorporates changes from the Finance Act of 2023. Interested parties, including members and stakeholders, can provide feedback until August 6, 2023, by emailing dtc@icai.in. The guidance note aims to assist members in conducting tax audits and preparing tax audit reports in accordance with Section 44AB of the Income Tax Act.

ICAI has a history of updating its Guidance Note on Tax Audit in response to changes in tax audit laws and reporting requirements. The revisions have been made periodically since the first version was released in 1985. Key amendments have prompted updates, such as the introduction and revision of various forms, including Forms 3CA, 3CB, and 3CD. The most recent edition, the 2022 version, incorporates all significant changes in income tax law and clauses in Form No. 3CD since the last publication. This updated guidance note covers reporting under Section 44AB and provides detailed information on Form 3CD and Form 6B for reporting under Section 142(2A). Additionally, separate guidance notes have been issued for auditing Public Charitable Institutions, reports under various sections of the Income Tax Act, and more. This revised 2022 edition aims to facilitate compliance with reporting requirements, streamline the tax audit process, and ensure timely reporting for Assessment Years 2022-23 and beyond, benefiting taxpayers and professionals alike.
